Executive Order Grants Authority to Seize Private Communications Facilities

The White House has released a new Executive Order seeking to ensure the continuity of government communications during a national emergency. The Executive Order grants new powers to the Department of Homeland Security, including the ability to collect certain public communications information. Under the Executive Order the White House has also granted the Department the authority to seize private facilities when necessary, effectively shutting down or limiting civilian communications.

    Well now…. That’s a big WTF.

    The government had the powers, via EBS (now EAS) to take over broadcast media in the event of an emergency. That was carefully designed, planned, controlled, and amended over the years to be a fairly well functioning system. Sure, they have problems, but they were almost trivial.

    This basically says that a government agent can flash a badge (or just make a call), and have it shut down.

    This concerns me. Someone wants more control than the EBS/EAS provided. That sounds much like they intend to be able to shut down any and all broadcast media.

    In the event of civil unrest, it is in the best interest of the government to be able to shut down the media. A news report of “Armed mobs have gathered in front of the White House in an apparent coup”, would likely increase the numbers in such a mob. If no one else knew about it, because it wasn’t going over broadcast or Internet media, most people would effectively be oblivious to the situation.

    There are already provisions to shut down Internet and cellular communications, either to a specific area, or specific reporting outlets. EOs are generally used sparingly, which does indicate there is an alternative reason for it.

    I haven’t read the full text of it yet, but I’m sure as we all read it, we’ll find significant problems with it. If you combine those with Bush Jr. era EOs, it paints a very ugly possible future.

    For those in the US, I’d strongly suggest getting a portable shortwave transceiver, and a simple to assemble high gain antenna (something you can keep in the trunk of your car). When SHTF, it may be your only means of communicating with anyone that is not in your immediate vicinity. I suggest portable, because fixed stations can be triangulated. At least with a portable station, by the time they’ve triangulated you, you’ve already moved on.
